1. Agreement to Terms

By accessing or using the TopAssets website, mobile application, or services (collectively, the “Platform”), you agree to be bound by these Terms & Conditions (“Terms”), along with our Privacy Policy and any applicable Listing Agreements. If you do not agree, you may not access or use the Platform.

2. Definitions

  • Content: Any data, text, images, photos, property details, videos, reviews, or other materials uploaded to the Platform.

  • Lister: A User who lists, advertises, or offers a property for sale or rent.

  • Seeker: A User who browses, searches, or inquires about properties.

  • User: Any person or entity who accesses or uses the Platform.

3. Our Role – Disclaimer

TopAssets is an online advertising and informational platform.

  • We are not a licensed real estate broker, agent, auctioneer, or advisor.

  • We do not verify the ownership, legality, or authenticity of properties or documents.

  • All transactions, communications, and negotiations are solely between Users. You must conduct your own due diligence.

  • We are not responsible for disputes, contracts, or payments between Users.

4. User Accounts & Eligibility

  • You must be at least 18 years old and legally capable of entering into a binding contract.

  • You are responsible for maintaining your account security.

  • You must provide accurate, current, and complete information.

5. Lister Responsibilities

By posting a property, you confirm that:

  • You have the legal right and authority to list the property.

  • All information and Content you provide is accurate and not misleading.

  • The listing complies with all applicable laws and regulations in Bangladesh.

  • You grant TopAssets a worldwide, royalty-free license to use, display, and promote your Content for marketing purposes.

6. Platform’s Rights

We reserve the right to:

  • Review, edit, or remove any Content that violates these Terms or applicable laws.

  • Suspend or terminate accounts or listings at our sole discretion.

  • Modify services, including paid listing features, at any time.

7. Paid Services & Payments

  • Basic listings are free. Premium services (e.g., featured ads, top placements) are available for a fee.

  • All payments are processed by third-party providers (e.g., SSLCOMMERZ, bKash) and are subject to their terms.

  • Fees for paid services are non-refundable unless required by law.

8. Privacy & Data Protection

We collect and process User information as described in our Privacy Policy. Key points include:

  • We collect account details, property information, communications, and device data.

  • We share data only with trusted third parties (e.g., hosting, analytics, payment providers).

  • We do not sell your personal data.

  • You have the right to access, correct, or request deletion of your data.

  • Data may be stored outside Bangladesh.

9. User Conduct

You agree not to:

  • Use the Platform for unlawful or fraudulent purposes.

  • Post duplicate, false, discriminatory, or misleading listings.

  • Harass or abuse other Users.

  • Use bots, scrapers, or automated tools without written permission.

  • Impersonate others or misrepresent your identity.

10. Indemnification

You agree to indemnify and hold harmless TopAssets, its partners, and employees against any claims, damages, or expenses arising from:

  • Your breach of these Terms.

  • Inaccurate or misleading Content you provide.

  • Any disputes between you and other Users.

11. Limitation of Liability

To the fullest extent permitted by law, TopAssets shall not be liable for:

  • Indirect, incidental, or consequential damages.

  • Loss of profits, goodwill, or data.

  • Unauthorized access, system interruptions, or security breaches.

12. Termination

  • Listers may remove their listings or close accounts at any time.

  • TopAssets may suspend or terminate access for violations of these Terms, without prior notice.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the People’s Republic of Bangladesh. All disputes shall be resolved exclusively in the courts of Dhaka, Bangladesh.

14. Changes to Terms

We may update these Terms at any time. If a revision is material, we will notify Users at least 30 days in advance. Continued use of the Platform means acceptance of the updated Terms.
